Ontario's ag-gag fight reaches the Supreme Court
Where it stands, Sep 5, 2026 Animal Justice filed for leave to appeal Ontario's ag-gag law to the Supreme Court of Canada, arguing the law violates the Charter's guarantee of free expression.
Animal Justice is asking the Supreme Court of Canada for leave to appeal Ontario's ag-gag law, which criminalizes entering a farm or slaughterhouse under false pretenses and which an Ontario court found partly unconstitutional before an appeals court reinstated it. It is the first such ag-gag challenge to reach Canada's top court, testing whether undercover investigation of factory farms keeps any constitutional protection in Canada.
