England's Pets Get a Positive Duty of Care

For nearly a century English law only asked that an animal not be made to suffer; on this day it started asking whether the animal was actually being looked after.

On 6 April 2007 the bulk of the Animal Welfare Act 2006 came into force in England, replacing protection law that dated to the Protection of Animals Act 1911. The old regime punished people only after cruelty had already happened. The new one, built around Section 9's duty to ensure welfare, made it an offence to fail to meet an animal's basic needs in the first place, whether or not any suffering had yet occurred. The Act had received royal assent the previous November, with its main provisions phased in through commencement orders running into the spring.

  1. A person commits an offence if he does not take such steps as are reasonable in all the circumstances to ensure that the needs of an animal for which he is responsible are met to the extent required by good practice.

Why it still matters

It shifted English animal law from punishing cruelty after the fact to requiring active care beforehand, the same welfare-needs framework that now underpins how neglect, not just abuse, gets prosecuted.
